Man, 49, Admits Having Anal Sex With 15 Year Old Boy: Sentenced To 9 Years Imprisonment

A male security guard has been sentenced to 9 years imprisonment after admitting having forced anal sex with his junior, a 15 year old boy, between September and October 2015.

The convict Epharaim Kangandula aged 49 who hails from Njalam’mano village of T/A Saimoni in Mneno district had anal sex with the boy in two separate occasions when both were on night duty.

Lilongwe Senior Resident Magistrate Court heard on Wednesday 13th January 2016 that both the convict and the victim were employees for Maka Security Company in the capital, city Lilongwe, and that the convict was a Security Supervisor.

Court heard from Police Prosecutor, Sergeant Daiton Phiri that in two separate occasions between 30th September and 5th October 2015, Mr. Kangandula had sexual acts with his male junior and these incidences happened at their office premises.

The prosecutor, explained in court that on the first occasion, just like it happened on the second day, the convict told the victim that they will work together at the office during the night. But in the middle of the night, the convict invited the young man into a dark room and switched off his torch when the boy entered the room.

Court heard that in both occasions, Mr. Kangandula, would lay on his back naked, ordering his junior to perform foreplay on his genitals. Then, he would order the boy to remove his pants while he stands in a bend position and have anal sex afterwards.

The prosecutor, Daiton Phiri, said, in all occasions, the young man was warned not to reveal the sexual ordeal to anybody and that if he does he will be killed.

Court was further told that, few days after the two separate incidences, the boy had abnormal stomach pains while at work and was sobbing  incessantly and was given pain killers by the convict. However, the pain never stopped and was forced to privately disclosed about the sexual encounter with his supervisor to his trusted workmate who took the matter to Area 36 Police Unit.

Kamuzu Central Hospital examination proved that there was canal knowledge.

On Wednesday, the convict asked court during mitigation that he wants leniency because he is old.

However, the Police prosecutor, Daiton Phiri prayed for stiffer punishment “This practice is unacceptable; in our laws, even in our cultures and our religious groups. More unfortunate thing is that this has happened to a young boy who is now traumatized by this incident. We pray for a stiffer sentence to deter the would be offenders”

In his verdict, Senior Resident Magistrate Paul Chiotcha said such acts are criminal in the country and agreed with prosecutor that it was sad that the incident happened to a young man. 

Before sentencing the man to 9 years imprisonment, Chiotcha also asked for good protection of young male victims in these incidences.

KCH Fake Doctor Gets 7 Years Imprisonment

The man who was arrested at Kamuzu Central Hospital (KCH) for impersonating a doctor has been sentenced to seven years imprisonment by Lilongwe Senior Resident Magistrate Court on Monday.

Rasford Gogoda aged 26 from Simon village of T/ASimon in Neno district was nabbed by police at KCH when people who knows him had alerted Area 33 police unit (located at the hospital) of suspicious doctor wandering about in patients wards.

The man was charged and convicted of two counts of Impersonating a public officer (medical doctor) and theft. The second count was put against him because of complaints from doctors who reported theft of personal items including phones and laptops during the time when the fake doctor was accessing doctors offices.

On mitigation factors, the convict pleaded that he has a family which depend on him and that he has a child with a special condition which requires weekly routine and is responsible of taking the child to hospital. 

State prosecutor Damian Kaputa prayed for stiffer sentence because Rasford Gogoda is not first time offender and further said the convict had endangered lives of people who got medical treatment from him.

Magistrate Senior Resident Paul Chiotcha agreed with the prosecutor saying he deserves a stiffer punishment to deter the would he offenders. Then slapped him with the sentence.

Snr. Resident Paul Chiotcha then sentenced the fake doctor to 6 years imprisonment for impersonation and 1 year jail sentence for theft. The two jail sentences will run consecutively.

In 2014, two men were separately arrested at Queen Elizabeth Central Hospital (QECH) in Blantyre on similar charges and both of them were  handed a 6-year jail term with hard labour. 

On 27th October 2014, Wongani Akuzike Kandulu  (whose name later changed to be Wongani Kumbukani Kandulu) was arrested after working for Queen Elizabeth Central Hospital for a while and lied to authorities that he was a college of Medicine student. He was sentenced to six years imprisonment by Blantyre Magistrate Court barely two weeks after another, illegally using the name Dr Zizwani Mwafulirwa’s but his real name is John Ben Kamanga, was also given similar custodial sentence by the same court.

Two Court Clerks, Watchman Granted Bail On Ivory, Cocaine Theft

The two Court Clerks and one security guard of Mkukula Magistrate court have been arrested on a case bordering on theft by servant contrary to section 286 of the penal code.

The three who appeared before Magistrate his worship Paul Chiotcha of Lilongwe Magistrate Court on Tuesday this week to answer charges of theft, have since been granted bail 

Particulars of the offense are that the three on the night of 30-31March 2015 broke into the office of the exhibit courtroom at Mkukula Court and stole assorted items including 5 trunks of ivory and cocaine which was seizured from different suspects and were tendered in court as evidence, so they were being kept at the court.

The accused, Austine Mbisa aged 29 of Fundi village T/A Kilipula, from Karonga district Chisomo Saukila aged 32 of Sumani village T/A Changata from Thyolo district and the security guard Edwin Kalukusha aged 40 of Kachaso village T/A Kalonga from Salima district have since denied the charge as the state is expected to parade 7 witnesses to prosecute the case.

The bail on conditions for the suspects are to pay a bail bond of K50, 000 each, have two sureties to sign for them and report to Lumbadzi police every fortnight.

The case has since been adjourned to a later date.
